This ‘Terms and Conditions’ document (“T&C”) governs the end users’ (“You/Your/User”) access to and use of ‘KISAN.net Platform’ shall be deemed to include the internet and mobile website www.samvaad.in as well as its mobile application and any other means to access the same from time to time and the services offered thereunder.

KISAN.net is owned and controlled by KISAN Forum Private Limited, a company formed and existing under the laws of India and having its Registered office at F-2, Rama Ganesh Building, 1170/17-B, Revenue Colony, Pune - 411005, India. (hereinafter referred to as " KISAN.net/Us/Our/We/ The platform "). Through KISAN.net, we provide you information in relation to events that are organized by third-party entities including but not limited to the dates, venue, ticket pricing and other event-related information and facilitates sale of tickets to such events, to You.

This T&C, along with the ‘Privacy Policy’ which constitutes an integral and inalienable part of the T&C, and any other applicable policies published on the KISAN.net, comprise a binding agreement between You and KISAN.net.

By using the Website or procuring any Services, the Users shall be deemed to have accepted these Terms as a binding document that governs User's dealings and transactions with the Company. If the User does not agree with any part of this Agreement, then the User must use or access the Website and must not avail the Services.

All rights and liabilities of the User and the Company with respect to any Services facilitated by the Company shall be restricted to the scope of these Terms.

The Company provides the Services subject to the notices, terms, and conditions set forth in these Terms. In addition, when you use the Website, you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such Services,which will be deemed to be incorporated into these Terms by reference.

The Company reserves the right to change, modify or suspend the Website, the contents thereof, the Services and these Terms at any time without any prior intimation to you. All modifications will be posted on the Website and will become effective immediately upon such posting to the Website. Use of the Website constitutes the User's acceptance of such Terms or provided by us in relation to any Services, as may be amended from time to time. Eligibility

• You will be eligible to transact on the Website only if you are above 18(eighteen) years of age, is of a sound mind and is not disqualified from contracting by any law to which he/she is subject.

We reserve the right to terminate your membership and/or block access to the Website if it is discovered that you are a minor or incompetent to contract according to the law or any information pertaining to your age entered at the time of creation of account is false.

You agree not to rearrange or modify the Content available through the Website. You agree not to display, post or frame the Content for use on any other websites, apps, blogs, products or services, except as otherwise expressly permitted under these Terms. You agree not to create any derivative work based on or containing the Content. The framing of or in-line linking to the Services or any Content contained thereon and/or the use of WebCrawler, spidering or other automated means to access, copy, index, process and/or store any Content made available on or through the Services other than as expressly authorized by us shall be prohibited. • Further, you are requested to report any User Content which is deemed to be unlawful, objectionable, libelous, defamatory, obscene, harassing, invasive to privacy, abusive, fraudulent, against any religious beliefs,spam, or is violative of any applicable law to samvaad@kisan.com. On receiving such report, the Company reserves the right to investigate and/or take such action as the Company may deem appropriate.
• The Website shall be used by bonafide User(s) for a lawful purpose. We reserve the right to terminate or restrict your access to the Website if, in our opinion, your use of the Services may violate any laws, regulations or rulings, infringe upon another person's rights or violate these Terms, for general maintenance or any other reason whatsoever. The Company reserves the right, in its sole discretion, to terminate the access to the Website and the Services offered on the same or any portion thereof at any time, without notice.

Your Acceptance

This is an agreement between KISAN Forum pvt. Ltd., the owner and operator of www.KISAN.net (the “KISAN.net Site”), the KISAN.net software, including KISAN.net Messenger (collectively, including all content provided by KISAN.net through KISAN.net Messenger and the KISAN.net Site, the "KISAN.net Service", or the "Service"), and you (“you” or “You”), a user of the Service. BY USING THE SERVICE, YOU ACKNOWLEDGE AND AGREE TO THESE TERMS OF SERVICE, AND KISAN.net PRIVACY POLICY, WHICH CAN BE FOUND AT (www.KISAN.net), AND WHICH ARE INCORPORATED HEREIN BY REFERENCE. If you choose not to agree with any of these terms, you may not use the Service.

KISAN.net Service

These Terms of Service apply to all users of the KISAN.net Service. Information provided by our users through the KISAN.net Service may contain links to third party websites that are not owned or controlled by KISAN.net. KISAN.net has no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, KISAN.net will not and cannot censor or edit the content of any third-party site. By using the Service, you expressly acknowledge and agree that KISAN.net shall not be responsible for any damages, claims or other liability arising from or related to your use of any third-party website

KISAN.net Access

Subject to your compliance with these Terms of Service, KISAN.net hereby grants you permission to use the Service, provided that:

• your use of the Service as permitted is solely for your personal use, and you are not permitted to resell or charge others for use of or access to the Service, or in any other manner inconsistent with these Terms of Service;
• you will not duplicate, transfer, give access to, copy or distribute any part of the Service in any medium without KISAN.net's prior written authorization;
• you will not attempt to reverse engineer, alter or modify any part of the Service; and
• you will otherwise comply with the terms and conditions of these Terms of Service and Privacy Policy.

In order to access and use the features of the Service, you acknowledge and agree that you will have to provide KISAN.net with your mobile phone number. You expressly acknowledge and agree that in order to provide the Service, KISAN.net may periodically access your contact list and/or address book on your mobile device to find and keep track of mobile phone numbers of other users of the Service. When providing your mobile phone number, you must provide accurate and complete information. You hereby give your express consent to KISAN.net to access your contact list and/or address book for mobile phone numbers in order to provide and use the Service. We do not collect names, addresses or email addresses, just mobile phone numbers. You must notify KISAN.net immediately of any breach of security or unauthorized use of your mobile phone. Although KISAN.net will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of KISAN.net or others due to such unauthorized use.
You agree not to use or launch any automated system, including without limitation, "robots," "spiders," "offline readers," etc. or "load testers" such as wget, apache bench, mswebstress, httpload, blitz, Xcode Automator, Android Monkey, etc., that accesses the Service in a manner that sends more request messages to the KISAN.net servers in a given period of time than a human can reasonably produce in the same period by using a KISAN.net application, and you are forbidden from ripping the content unless specifically allowed. Notwithstanding the foregoing, KISAN.net grants the operators of public search engines permission to use spiders to copy materials from the website for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. KISAN.net reserves the right to revoke these exceptions either generally or in specific cases. While we don't disallow the use of sniffers such as Ethereal, tcpdump or HTTPWatch in general, we do disallow any efforts to reverse-engineer our system, our protocols, or explore outside the boundaries of the normal requests made by KISAN.net clients. We have to disallow using request modification tools such as fiddler or whisker, or the like or any other such tools activities that are meant to explore or harm, penetrate or test the site. You must secure our permission before you measure, test, health check or otherwise monitor any network equipment, servers or assets hosted on our domain. You agree not to collect or harvest any personally identifiable information, including phone number, from the Service, nor to use the communication systems provided by the Service for any commercial solicitation or spam purposes. You agree not to spam, or solicit for commercial purposes, any users of the Service.

User Status Submissions

• The KISAN.net Service allows KISAN.net users to submit status text, profile photos and other communications submitted by you, as well as the automatic submission of your “last seen” status (collectively, the "Status Submissions"). These Status Submissions may be hosted, shared, and/or published as part of the KISAN.net Service, and may be visible to other users of the Service who have your mobile phone number in their mobile phone and which you have not expressly blocked. For clarity, direct messages, location data and photos or files that you send directly to other KISAN.net users will only be viewable by those KISAN.net user(s) or group(s) or channel (s) you directly send such information; but Status Submissions may be globally viewed by KISAN.net users that have your mobile phone number on their smartphone, unless the user is blocked by you. You acknowledge and agree that any Status Submissions may be globally viewed by users that have your mobile phone number, so don’t submit or post status messages or profile photos that you don’t want to be seen globally. A good rule of thumb is if you don’t want the whole world to know something or see something, don’t submit it as a Status Submission to the Service. The submission of your 'last seen' status is done on an automatic basis. As clarified in the following section, you retain your ownership rights in your Status Submissions. You understand that whether or not such Status Submissions are published, KISAN.net does not guarantee any confidentiality with respect to any submissions.
• You shall be solely responsible for your own Status Submissions and the consequences of posting or publishing them. Because KISAN.net is only acting as a repository of data, user submitted statuses do not necessarily represent the views or opinions of KISAN.net, and KISAN.net makes no guarantees as to the validity, accuracy or legal status of any status. In connection with Status Submissions, you affirm, represent, and/or warrant that: (i) you own or have the necessary licenses, rights, consents, and permissions to use and authorize KISAN.net to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all Status Submissions to enable inclusion and use of the Status Submissions in the manner contemplated by the Service and these Terms of Service; and (ii) you have the written consent, release, and/or permission of each and every identifiable individual person in the Status Submission to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the Status Submissions in the manner contemplated by the Service and these Terms of Service.By submitting the Status Submissions to KISAN.net, you hereby grant KISAN.net a worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Status Submission in connection with the KISAN.net Service, including without limitation for promoting and redistributing part or all of the KISAN.net Service (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each subscriber to your status on the KISAN.net Service a non-exclusive license to access your Status Submissions through the Service. The foregoing license granted by you terminates once you remove or delete a Status Submission from the KISAN.net Service.
• In connection with Status Submissions, you further agree that you will not: (i) submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant KISAN.net all of the license rights granted herein; (ii) publish falsehoods or misrepresentations that could damage KISAN.net or any third party; (iii) submit material that is unlawful, obscene, defamatory, libelous, threatening, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate; (iv) impersonate another person; (v) send or store material containing software viruses, worms, Trojan horses or other harmful computer code, files, scripts, agents or programs; (vi) interfere with or disrupt the integrity or performance of the Service or the data contained therein; or (vii) attempt to gain unauthorized access to the Service or its related systems or networks.
• Adult content must be identified as such. KISAN.net does not endorse any Status Submission or any opinion, recommendation, or advice expressed therein, and KISAN.net expressly disclaims any and all liability in connection with Status Submissions. KISAN.net does not permit copyright infringing activities and infringement of intellectual property rights via its Service, and KISAN.net will remove all content and Status Submissions if properly notified that such content or Status Submission infringes on another's intellectual property rights. KISAN.net reserves the right to remove content and Status Submissions without prior notice. KISAN.net may also terminate a user's access to the Service, if they are determined to be a repeat infringer, or for any or no reason, including being annoying. A repeat infringer is a User who has been notified of infringing activity more than once and/or has had a Status Submission removed from the Service more than twice. An annoying person is anyone who is (capriciously or not) determined to be annoying by authorized KISAN.net Admin. KISAN.net also reserves the right to decide whether content or a Status Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement and violations of intellectual property law, such as, but not limited to excessive length or limited interest. KISAN.net may remove such Status Submissions and/or terminate a User's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.
• You understand that when using the KISAN.net Service you will be exposed to Status Submissions from a variety of sources, and that KISAN.net is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such Status Submissions, and that such Status Submissions are not the responsibility of KISAN.net. You further understand and acknowledge that you may be exposed to Status Submissions that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against KISAN.net with respect thereto, and agree to indemnify and hold KISAN.net, its officers, directors, employees, agents, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the KISAN.net Service.
• KISAN.net permits you to link to materials on the Service for personal purposes only. KISAN.net reserves the right to discontinue any aspect of the KISAN.net Service at any time.

Warranty Disclaimer

YOU AGREE THAT YOUR USE OF THE KISAN.net SERVICE SHALL BE AT YOUR SOLE RISK. (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT,

KISAN.net DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE KISAN.net SERVICE OR ANY HYPERLINKED WEBSITE OR FEATURED IN ANY USER STATUS SUBMISSION OR OTHER ADVERTISING, AND KISAN.net WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. Limitation of Liability

(II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE,
(III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN,
(IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVERS,
(IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY,
(V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE KISAN.net CLIENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND/OR (VI) THE DISCLOSURE OF INFORMATION PURSUANT TO THESE TERMS OF SERVICE OR PRIVACY POLICY. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. YOU SPECIFICALLY ACKNOWLEDGE THAT KISAN.net SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.
The Service is controlled and offered by KISAN.net from its facilities in INDIA. KISAN.net makes no representations that the KISAN.net Service is appropriate or available for use in other locations. Those who access or use the KISAN.net Service from other jurisdictions do so at their own volition and are responsible for compliance with local law.

Indemnity

You agree to defend, indemnify and hold harmless KISAN.net, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:
(i) your use of and access to the KISAN.net Service;
(ii) your violation of any term of these Terms of Service;
(iii) your violation of any third party rights, including without limitation any copyright, property, or privacy right; or
(iv) any claim that one of your Status Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the KISAN.net Service. We don't support or encourage illegal consumption of alcohol or tobacco, so there.

Ability to Accept the Terms of Service

You affirm that you are either more than 16 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. In any case, you affirm that you are at least 16 years old as the KISAN.net Service is not intended for children under 16. If you are under 16 years of age, you are not permitted to use the KISAN.net Service.

Assignment

These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by KISAN.net without restriction.

General

You agree that:
(i) the KISAN.net Service shall be deemed solely based in India;
(ii) the KISAN.net Service shall be deemed a passive server that does not give rise to personal jurisdiction over KISAN.net, either specific or general, in jurisdictions other than India; and
(iii) that you agree to subject to the jurisdiction of India in the event of any legal dispute. These Terms of Service shall be governed by the internal substantive laws of the State of India, without respect to its conflict of laws principles. Any claim or dispute between you and KISAN.net that arises in whole or in part from the KISAN.net Service shall be decided exclusively by a court of competent jurisdiction located in Maharashtra, India. These Terms of Service, together with the Privacy Policy at (www.KISAN.net/terms) and any other legal notices published by KISAN.net, including, but not limited to an end user license agreement, shall constitute the entire agreement between you and KISAN.net concerning the KISAN.net Service. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. No waiver of any term of this these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and KISAN.net's failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision. KISAN.net reserves the right to amend or modify these Terms of Service at any time, and it is your responsibility to review these Terms of Service for any changes. If you do not agree to the revised Terms, your only recourse is to discontinue the use of the KISAN.net Service. Your continued use of the KISAN.net Service following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms. YOU AND KISAN.net AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE KISAN.net SERVICE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

Security and Account Related Information

• While registering on the Website, you shall choose a password to access your account and you shall be solely responsible for maintaining the confidentiality of both the password and the account as well as for all activities on the account. It is your duty to notify the Company immediately in writing of any unauthorized use of your password or account or any other breach of security. The Company will not be liable for any loss that may be incurred by you as a result of unauthorized use of the password or account, either with or without your knowledge. You shall use only your account at all times.
• You understand that any information that is provided to this Website may be read or intercepted by others due to any breach of security at your end.
• The Company keeps all the data in relation to credit card, debit card, bank information etc. secured and in an encrypted form in compliance with the applicable laws and regulations. However, for cases of fraud detection, offering bookings on credit (finance) etc., the Company may at times verify certain information of its users like their credit score, as and when required.

Advertisements

• The Website may contain links to third party websites. The Company does not control such websites and is not responsible for their contents. If you access any third-party website, the same shall be done at your own risk and the Company shall assume no liability for the same.
• The Company is not responsible for any errors, omissions or representations on any of its pages, links or any linked website pages to the extent such information is updated or provided directly by the service provider or the advertisers.
• The Company does not endorse any advertisers on its Website, or any linked sites in any manner. You are requested to verify the accuracy of all information provided on the third-party web pages.
• The linked sites are not under the control of the Company and hence the Company is not responsible for the contents of any linked site(s) or any further links on such site(s), or any changes or updates to such sites.

• SEVERABILITY: If any provision of these Terms are determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of these Terms shall continue to be in full force and effect.
• JURISDICTION: This Agreement is subject to interpretation as per the laws of the Republic of India, and the parties shall refer any unresolved disputes to the exclusive jurisdiction of Pune, Maharashtra.
• AMENDMENT TO THE TERMS: The Company reserves the right to change the Terms from time to time. You are responsible for regularly reviewing the Terms.
• FEEDBACK FROM USER: The Company may require the feedback of its users for improving the Services. You shall hereby authorize the Company to contact you for your feedback on various Services offered by theCompany. Such feedback may be collected through emails, telephone calls, SMS or any other medium from time to time.
